Terms of Use

1. Acceptance of terms

These Terms of Use ("Terms") are an agreement between you and SmartNest Developers covering your use of the SmartNest mobile application (the "App"). By downloading or using the App, you accept these Terms. If you do not accept them, do not use the App.

2. Use of the App

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on a device you own or control, for personal, non-commercial purposes, in line with these Terms and the Google Play terms of service.

You agree not to:

Copy, modify, distribute, sell, or lease any part of the App;
Reverse engineer or attempt to extract the App's source code, except where the law or an open source license permits it;
Use the App for anything unlawful, harmful, or abusive;
Interfere with the App's operation or attempt to access it by any means other than the interface we provide.

3. AI-generated content

The App runs open-source AI language models on your device to generate text responses. These responses are produced by statistical models and may contain inaccuracies, errors, or unsuitable content. You should not rely on AI-generated content as professional, medical, legal, or financial advice. SmartNest Developers is not responsible for actions taken based on AI-generated output.

4. Accounts

If the App lets you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Provide accurate information and tell us promptly about any unauthorized use.

5. Intellectual property

The App, including its design, text, graphics, logos, and code, is owned by SmartNest Developers or its licensors and is protected by copyright and other laws. Open source components included in the App are licensed under their own terms — see our Open Source Licenses page.

6. AI model licenses

The AI models available for download inside the App are created by third parties and distributed under their own licenses. By downloading and using a model, you agree to that model's license terms. SmartNest Developers does not create or modify these models.

7. User content

Your conversations with AI models are stored locally on your device and are not transmitted to us. You are responsible for any content you generate using the App. You must not use the App to generate content that is illegal, infringing, harmful, or abusive.

8. Updates and availability

We may update, change, suspend, or discontinue the App or any feature at any time, with or without notice. We are not liable if the App is unavailable at any time or for any period.

9. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Your use of the App is at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, SmartNest Developers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the App.

11. Termination

We may suspend or end your access to the App if you breach these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

12. Governing law

These Terms are governed by the laws of the United Arab Emirates. Any dispute arising from these Terms or the App will be subject to the jurisdiction of the courts of the UAE.

13. Changes to these Terms

We may revise these Terms from time to time. The updated version takes effect when posted here, and the "Last updated" date above will change. Continuing to use the App after changes means you accept the new Terms.
